Samantha Ruth Prabhu AI Case: Actress Samantha Ruth Prabhu से जुड़े AI-generated Deepfake और Morphed Content के मामले में Bombay High Court ने बड़ा Interim Order दिया है। Court ने Samantha के Name, Image और Voice के Unauthorized Use पर रोक लगाते हुए उनसे जुड़े Unauthorized Content को हटाने का निर्देश दिया है।
यह मामला Samantha के Personality Rights, Publicity Rights और Performers’ Rights से जुड़ा है। Court ने कहा कि सामने रखी गई सामग्री से पहली नजर में इन Rights के उल्लंघन का मामला बनता है।

Samantha Ruth Prabhu ने Bombay High Court का रुख करते हुए अपने Name, Image, Voice और Likeness के Unauthorized इस्तेमाल से Protection मांगी थी।

LiveLaw के अनुसार, Court ने Google, Meta Platforms और अन्य Social Media Platforms तथा unidentified parties को Samantha से जुड़े आपत्तिजनक Content को हटाने का निर्देश दिया।
AI Deepfake Content पर Court ने क्या कहा?
Court ने रिकॉर्ड पर मौजूद Material को देखते हुए कहा कि Samantha के Personality और Publicity Rights के Prima Facie Violation का मामला बनता है।
Order में उनके Privacy Rights और Performer’s Moral Rights का भी उल्लेख किया गया है। Court ने इन Rights को Constitution के Article 19(1)(a), Article 21 और Copyright Act के Section 38B के तहत मिलने वाली सुरक्षा से जोड़ा।
इसका मतलब यह है कि किसी Celebrity की पहचान से जुड़े Elements को बिना अनुमति AI-generated या Morphed Content में इस्तेमाल करने का सवाल अब सिर्फ Entertainment या Social Media का मुद्दा नहीं रह गया है, बल्कि Legal Rights से भी जुड़ रहा है।

Court ने यह भी स्पष्ट किया कि Online Intermediaries को ऐसे मामलों में Due Diligence की जिम्मेदारी निभानी चाहिए।
Celebrity Rights और AI को लेकर क्यों महत्वपूर्ण है यह मामला?
AI Technology के बढ़ते इस्तेमाल के साथ किसी व्यक्ति की तस्वीर, आवाज और पहचान से मिलता-जुलता Content तैयार करना पहले की तुलना में काफी आसान हो गया है।
Samantha का मामला इस वजह से खास है क्योंकि इसमें AI Deepfake, Celebrity Identity और Personality Rights तीनों एक साथ सामने आए हैं।
